Post subject:  Non-Payment of communal fees

Dear Sofia & Haris,
Some of the owners of our development have formed an Association and would like your advice as to how we can get the owners who have not paid their communal fees, to pay. What avenues are open to us?

Dear Cathy,

Thank you for your question. If there is an Association/Committee for the project then you can take legal action against the owners who do not pay.

Off-course before you proceed with the Court, the Association/Committee can send a formal notice through a Lawyer, I have found that many people pay when they receive this notice.

Dear Haris,
Thank you for your reply. We are nearly to the 'solicitor's letter' stage. Are we able to place a 'memo' on the non-payer's property at the Land Registry? We do not have our separate title deeds yet?

Dear Cathy,

You can put a Memo to land registry office if:

1. There is a Judgment from the Court against the person
2. The person who owns the money is the registered owner of property at the land registry office.
Thus if there is no separate title deed you can not register the Memo.
