Post subject:  LEGAL ADVICE NEEDED - BUILDER PROBLEMS

We are having a house built by a Cypriot builder.

This has been ongoning now for 2 years and our builder has no money to continue our house.

To make matters worse we have been stupid enough to pay him in advance for some of the build and we estimate there is approximately CY£50,000 of work and fixtures / fittings that has been paid for and is yet to be done.

We have decided it's time for us to employ another builder to finish the house.

The legal advice I need is with regards to what can we do to get our money back from our current builder.

It's likely that, as soon as he is put under legal pressure he will just go bankrupt, which may mean that we will never see our money again.

We currently live in the UK but our plan is to move to Cyprus for good in a few years, once our house in finished and we're in a position to pay off the mortgage.

We will be in Cyprus again for 2 weeks in early January.

I would welcome any guidance.

Hi. Really sorry to read about what has happened to you. What does your lawyer say? You will need to speak to him/her first. However, if they are the same lawyer as the developers then I would suggest that you change that arrangement as soon as possible. I would be happy to meet with you early January to discuss. Hi, thanks for your response.

My lawyer has not given me a great deal of advice at all. I have sent him several faxes asking how we stand legally but he is really slow in responding - if he responds at all.

I believe that our lawyer is also involved our builder as I believe they do know each other. We have been considering obtaining a second opinion, especially after the past few weeks.

the shame is that our lawyer has helped us quite a lot in other areas and seems to be very helpful most of the time. He is also part of our power of attorney in Cyprus (along withmour daughter).

The last advice we got from our lawyer wasa to say that the builder had disappeared and that we should get another builder to finish the job.

We have since seen our builder and thought we had come to a good agreement of how to continue but the buielder has stopped communicating with us again and none of his numbers work - although I know he is in his office several days a week.

Whereabouts are you located in Paphos? We can bring as much of the documentation as possible when we come ober in January and call you to make an appointment.
