We are now completing the forms for this and one question

we are asked to provide a copy of the rental agreement lease we have and it quotes (duly stamped) what does this mean.... do we have to have the rental agreement authorised by someone...

IF SO.....who? and how

thank you - i thought we had to have it stamped by tax or local authority or some sort of regulatory body

We have not got ours sorted yet but were told that the rental agreement had to be "stamped". On enquiring we were told that your rental agreement has to have a stamp purchased from the Post Office on it. The cost of the stamp will vary, depending on the date of the rental agreement. I discussed this with my landlord and his suggestion was that he would let us have a new rental agreement dated the day before we went to the Post Office.

In fact this thread has just nudged me to get this sorted sooner rather than later.

When I registered for Cyprus tax the woman who I dealt with insisted the rental contract had to have a stamp to make it a legal document apparently. There is a sliding scale of costs for the stamp dependent on how long the contract is for and the date it was drawn up. So the cheapest way is to have a 12 months contract dated just before purchasing the stamp which can be obtained from the 'Stamps Office' which is in the same building as the tax registration office.

The Stamp Duty payable to the tax authorities on a property rental agreement has been in existence for years.

A contract not stamped is often not legally enforceable and the landlord is breaking the law by failing to notify the tax authorities of the contracts existence. The stamp duty payable is the responsibility of the landlord.

The EAC and other service providers are now requesting proof of correctly lodged contracts as a 'favour' :bearhug to the tax authorities who have been aware for many years of the number of landlords who do not declare any rental income on their tax returns. :huff This method makes the authorities aware that a contract exists, its worth, and allows them to keep an eye out for the income being declared.

Although it's the landlords' responsibility, I assume that the tenant can still have it stamped and pay for the revenue stamp?

so what do we do go to the PO or the tax office.....dont want to be paying twice.. and does this implicate the landlord.. i guess it does...

Defiantly not the post office , the tax office is the place that has to tell you how much in stamps you need , so get your stamp while you are there . And the landlord does not need to be involved .

We moved house recently and EAC did not insist that our rental agreement should have a stamp on it .

I agree number 6 - we had no problems with the EAC...in fact it was a very good experience and a complete and utter contrast to the way they do things in Malta...... so its just the tax office so we can do to all there thats fab... thanks all

well we did the tax office trip today and it was ok -all done and €190 lighter - but a tad puzzling....

we had all the paperwork and after a bit of argy bargy over the rental contract - there was some confusion as we were asked to have it notarised by the Mukhtar at the muncipality as well as stamped with €30 worth of stamps.. got the stamps and affiixed them - didnt bother with the notarising at all = then paid for the €80 each of tax registration stamps affixed them to the forms - provided all the copies as requested and offered the rental contract but that dept werent really that interested - although they do ask for the name of the landlord on a questionaire.......

so walked out lighter in the pocket but at least its done and we are supposedly safe from a tax return until april 2016...

So you pay Cypriot tax in arrears annually and I assume that the UK will give you a tax code of NT (Nil Tax) wef 1 Apr 15?

nearly 5 months have now passed and have had no communication from either HMRC nor the Cypriot Inland Revenue Dept.. Is this normal ( we were told by the lady in IRD that it would take 4months or so) or should I be chasing this up,,, now before it goes too far.

How does one know if theyve dealt with the tax registration and the application for the Dual Taxation agreement with UK

Toonarmy - I would telephone the HMRC and go to the Tax Office in Paphos to find out what was happening and keep a record of both conversations complete with the name of the person I spoke to ( so if there's a problem later on you can say you actually contacted the respective departments).

I have contacted the HMRC and await their reply...... I will be going to the tax dept paphos this week...

I now have concerns that if they've lost it all i may be required to not only supply all information again but pay again too as no receipts for anything were given...

well the good news is we have had word from our HMRC tax office that all is in order now and we have confirmation that we are NT rated in UK so jobs a goodun... thank god for that
