 Post subject: maintanance contracts

Can anyone offer advice regarding setting up an owners committee.I live in a small newly built block in Geroskipou there are only ten units but we need to get things moving regarding insurance,cleaning contracts,pool maintanance etc. I have a list of owners and landlords any advice regarding how to go about things,what we need to consider and should we get a solicitor involved. We would be grateful for any advice and any pitfalls to avoid. Dave

Do you all have your title deeds or is the developer / landlord still the registered owner?

we have only just moved in so we have no title deeds and things are still in the developers name we have a letter asking us to form a committee or appoint someone as
a temporary "building manager" and he has asked us to make a priority of having the electricity and water account transfered to our names/accounts as they are currently registered to him,we have already set up direct debit for electricity and paid a water bill at the muncipal offices so a guess we need to get all the others to do the same. Everything is very ammicable and helpful

From what I can remember to set up a Management Committee you need to have it registered at the Land Registry? Better to get a deposit from everybody in the complex as I believe sometimes this is the worst part of it. Also make sure you have enough in the kitty in case of any problems because otherwise the committee could end up with a huge bill and unable to collect all the money.

I think you can do it yourself if you have someone who can speak Greek fluently, otherwise go to a solicitor IMO

I have read threads where people on a complex refuse to pay as they feel only there for short periods of holidays the pool is not used as much as residents.It could be set out by meter size of property so if you own large property you pay more.That is how ours is set out.We are still with developer and hes chases bills.We had opportunity for our own committee to run but found it easier not to.I would def involve lawyer.

Strictly speaking the only person who can set up a management committee is the developer as he is still the owner of the property. Until you have the deeds, then you are not owners and do not have the right to do this. However, if he is willing to allow you to do this and he is named on the agreement as so willing thn it should not be too much of a problem. The biggest problem is collecting money from people. As with any flat / appartment arrangement, so long as everyone moves in the same direction then all is well, but it only takes one person to upset the apple cart. You need to have a look at some law as regards the setting up of the agreements and what you can and cannot do. The relevant piece of legislation is called The Immovable Property (Tenure Registration and Valuation)(Amendment Law) 1993 (exciting bedtime reading I can tell you!).
As has been advised by others, get a lawyer to draw the necessary documents up. The cost would be in the region of about 1500 euros and needs to be signed by everyone and of course the cost would be divided by the number of residents.

Thanks for the reply,it seems as if we need to hope that everyone co-operates and if they do it should work out ok. I am back in a couple of weeks so i hope to get the ball rolling I also think it would be a good idea to go back to the lawyer that we employed to buy the property and seek advice and get a cost from him.At the moment we will think positive!! thanks Dave

There is always the option to get a management company. The Contract can be signed with each flat owner individually, that will put the hard task of money collection on the management company, and theres no need for a management committte and the comunnal bills are handed by the management company. if you are intressted in this option, you can call GV on 96536639 they should be able to offer you some advice or free quotes.
