My solicitors are driving me crazy! They have requested so many documents, from the day my husband died in Feb 2008, up to Jan 09. Every time I get the next document they request another, and they are telling me that I am holding up Probate! Can anyone give me an actual list of what documents are actually required for Probate, because I think that my solicitors are "pulling a fast one" in order to increase their bill.

Many thanks
Janalld

Depends which country you are in. Here, Scotland England etc all have intestacy rules etc.

If you are unhappy with the time, tell the solicitor first then approach the relevant law society to carry out a case audit.

I live in district of Paphos, where my husband died. I have not been able to locate a relevant Law Society or office. I have spoken to other solicitors and asked them what would be required and their responses varied from 6 to 28 documents!!!!

Some of the documents requested by my solicitors include copies of my two sons passports (both in their thirtees and neither living in Cyprus), plus copies of their birth certificates. My husbands Will left everything to me absolute so I do not see the relevance of solicitors wanting copies of my sons passports and birth certificates.

Trying to cope with my husbands sudden death at the age of 57 is traumatic enough, but having to deal with solicitors who are forever moving their goal posts is really sending me over the edge.

Regards

Janalld

Hello Janalld

Sorry I have not been able to reply to your post for ages and ages.

I assume that you are British as was your late husband? If he was, then they will need is the will, death certificate, mukhtars certificate and details of the assets he held here in Cyprus, his title deed to your property if you have it and if not the contract of sale between your developer and you and your late husband. Hope this helps. If I can assist any more please call me on 96549826. Mark.
